Landlords Statutory Declarations

Deed of Trust

Deed of Trust

A Deed of Trust, also referred to as a Declaration of Trust, is a document, executed as a deed, which specifies how a property is held between joint owners. Our Basic Deed includes a fixed beneficial interest split and can explain what each party contributed to the property, your responsibilities regarding outgoings, and what you agree to do on sale.

Floating Deed of Trust

A floating deed of trust allows the co-owners of a property to have a beneficial interest that changes over time by their individual contributions toward:
Purchase price (deposit/current equity split), purchase costs (SDLT, legal fees, etc.), repairs/renovations, mortgage repayments.

Joint Borrower Sole Proprietor - Deed of Trust

Created for the Joint Mortgage Sole Proprietor mortgage, this deed confirms a zero beneficial interest for the non-legal owners for Stamp Duty Land Tax purposes and includes how to sell (something a non-legal owner can't do without a deed) and indemnities in the event of the legal owner failing to pay the mortgage.

Tenants in Common to Joint Tenancy - Deed of Trust

If you have previously been registered as tenants in common you will need to execute a Deed of Trust in order to register as joint tenants. The deed is required to evidence your intention to sacrifice your individual share, becoming 100% joint owners, with no right to make a claim to any previous benefit. This will ensure that any future transactions are carried out according to your new Joint Tenant status, as opposed to your previous beneficial interest split as Tenants in Common.

Declaration of No Interest

Used by legal owners who have someone living in their property or moving into their property over the age of 18 for whom they want to confirm the position that they have no beneficial interest in the property regardless of what they pay toward the property.
