Protect Your Future: Why a Pre-nup or Post-nup Could Be One of the Smartest Legal Steps You Take

When you’re planning a life together, the last thing on your mind is what happens if it ends. But just like making a Will or taking out insurance, putting legal protections in place now can save a great deal of stress and uncertainty later.

At Parachute Law, we help couples across England and Wales create clear, fair agreements — entirely remotely — that protect both parties and bring peace of mind.

Two of the most effective tools for this are Pre-nuptial Agreements and Post-nuptial Agreements.

What Are They?

• A Pre-nuptial Agreement (often referred to as a "Pre-nup") is a legal agreement made before marriage or civil partnership.
• A Post-nuptial Agreement is made after you are already legally married or in a civil partnership.

Both set out what should happen to your assets, income, property, and debts if your relationship were to break down in future.

Why Are They Helpful?

Whether you’re newly engaged, already married, or entering a civil partnership, having a nuptial agreement in place helps you:

·   Protect your pre-marital assets or inheritance

·   Safeguard a business or family property

·   Support children from previous relationships

·   Avoid costly, stressful disputes later on

·   Set clear expectations and avoid uncertainty

These agreements don’t mean you’re expecting things to go wrong — they mean you’re planning responsibly and with respect for each other’s future.

Are They Enforceable?

English courts increasingly respect Pre-nuptial and Post-nuptial Agreements, provided:

·   Both parties took independent legal advice

·   The agreement was entered into freely without pressure

·   Both parties fully disclosed their financial situation

·   The terms are fair and meet the parties’ basic needs (especially if children are involved)

·   The Agreement was entered into at least 28 days before the wedding (in the case of Pre-Nuptial Agreements)

If all those boxes are ticked, your agreement is likely to be followed in the event of a divorce.
