Employment tribunal costs and fees from Parachute Law

One of the first things you will need to consider before taking action against your employer is the employment tribunal costs.

How much does an employment tribunal cost?

The employment tribunal does not charge a fee for making a claim. However, just because there are no employment tribunal fees doesn't mean the whole process will be cost free.

Even if you bring your claim yourself, without any legal help, you run the risk of being ordered to pay the other side's costs. This is the default if you lose in court. At tribunal, you would have to break some important rules to face a costs order, you can read them in the Employment Tribunals Rules of Procedure 2013

‘Costs’ might include legal fees (solicitor’s fees) and reimbursement for the time that the winner and any of their unpaid helpers or advisors have spent preparing the argument for court, (£40 per hour).

Additional Costs
Hearings
There may be an additional fee if you would like to be accompanied at your hearing, or represented by our specialist employment barrister. Your hearing is likely to take place over 1 to 5 days and will be charged based on the seniority of the person you would like to enlist to attend with you, from £1,400 – £3,000 per day excluding VAT.
Counsel's fees
If we take your case through tribunal we will handle your disbursements. These are fees you pay to third parties, which may include court fees, travel expenses or the costs of obtaining reports. Counsel fees may cost between £500 – 4,000 per day for preparing for and attending a Tribunal Hearing.

  • Providing information about an existing claim
  • Defending claims brought by litigants in person
  • Making or defending a costs application
  • Complex preliminary issues including whether a claim is late or falls under the correct jurisdiction
  • A higher number of witnesses and documents
  • A hearing extending over more than five days
  • 'Automatically' unfair dismissal claims
  • Additional regulations applying to your field of work
