In the recent case of Culligan v Culligan [2025], a spouse’s hidden £371,000 crypto holding was revealed during proceedings, with serious consequences.
Unfortunately, because Form E (the standard disclosure form) does not specifically ask about digital assets, crypto is sometimes missed—or deliberately concealed.
The challenges of cryptocurrency in divorce
• Hidden crypto assets – Digital coins can be moved to offshore exchanges, cold wallets, or privacy-focused tokens, making them harder to trace.
• Crypto valuation in divorce – Markets are volatile, with values often changing significantly between disclosure and court hearings.
• International enforcement – If assets are held overseas, obtaining records or enforcing orders can be more complex.
Despite these challenges, the courts are adapting. Judges now issue disclosure and freezing orders against major exchanges and may use averaged valuations to account for market swings.
